§ 13.24.060. Compliance evaluations.

  • The building department and public works shall have the right of access to any commercial premises within the village for the purposes of reasonable inspection to ascertain whether such premises are in compliance with this chapter.

    A.

    New or Remodeled Facility Inspection. During a facility inspection of a FOG producing facility, the building inspector or his/her designee shall verify the following that: (1) the required sizing criteria has been applied, (2) all necessary parts are in place (e.g. baffles, influent/effluent tees, and required screens), (3) all fixtures required to be connected to the interceptor are connected, and (4) all requirements of local ordinances have been met. The building inspector shall draw a schematic of the fixtures and equipment attached to the GI. The inspector shall also include a drawing of the interceptor showing the layout of the baffles, "T's" and other important features. Additionally, the building inspector shall note whether the facility owner/operator has a copy of the local FOG ordinance and a copy of all required paperwork on site.

    B.

    Annual Inspection. During an annual inspection of a FOG producing facility, the public works supervisor in cooperation with the building inspector will verify the following, that: (1) all appropriate fixtures are connected to the GI and have required screens, (2) the current maintenance frequency is adequate by applying the twenty-five (25) percent rule, and (3) the records are being properly maintained. The main focus of the public works supervisor in cooperation with the building inspector during an annual inspection of a FOG generating facility is the overall operation of the grease interceptor. The supervisor in cooperation with the building inspector shall make sure that all appropriate fixtures are attached and the required screens are in place.

    The owner/operator or facility representative shall, upon request of the village official(s) (building department, public works) open the GI(s) for the purpose of confirming that the maintenance frequency is appropriate, all necessary parts are in place (e.g. baffles, influent/effluent "T's", and screens), and that the device is being maintained in efficient operating condition.

    In the event any of the aforementioned system(s) is/are damaged or missing, the system(s) must be repaired or installed, within no more than thirty (30) days. Defective or missing equipment will cause inadequate separation.

    C.

    Notice of Violation. Facilities which are required to pump and/or repair interceptors, as documented by inspectors, shall be given five days and thirty (30) days upon receipt of notice, respectively. notice of violation (NOV) letters shall be sent via certified mail with a copy sent to the NWRWRF's pretreatment department.

    For interceptors needing repair (e.g. replacement caps on 'tees'), the owner/operator will be issued a NOV letter. This NOV shall specify the repair(s) in detail along with a diagram showing location of faulty items. A deadline date for completion of repairs shall be thirty (30) days from date certified letter is signed for.

    D.

    Follow-up Inspections. Facilities with violations shall be re-inspected by the building official and/or the public works department within thirty (30) days from the facility receiving the NOV to ensure compliance. All re-inspections shall be billed to the FOG producing facility found to be in violation of this chapter. The charge for the first re-inspection shall be fifty dollars ($50.00). If violation has not been corrected by the time of the follow-up inspection, a new NOV will be issued along with one hundred and fifty dollar ($150.00) fine. Any subsequent follow-up inspections for original violation shall be billed at one hundred dollars ($100.00). If after the second NOV and subsequent inspection the facility is found to remain in non-compliance for original violation the NWRWRF's pretreatment department shall be notified to take further action (e.g. issuing a wastewater discharge permit).

    E.

    Demand Inspections. An inspection shall be conducted any time a FOG related SSO or blockage has occurred. These inspections along with the labor required to correct the problem shall be billed to the FOG producing facility. The inspection shall be billed at fifty dollars ($50.00) and the labor shall be billed at eighty-five dollars ($85.00) per hour with a minimum of two hours.

    F.

    Enforcement Action. Upon completion of an on-site annual inspection, the public works department shall complete the inspection report form in Exhibit 4 of the ordinance codified in this chapter with any NOV(s) attached and forward it to the NWRWRF's pretreatment department annually by January 31st of each year. The pretreatment department will review the reports and NOV's, if further action is needed the NWRWRF will follow-up.
